Can a Foreigner Buy an Apartment in Bosnia and Herzegovina?

Yes. Foreign nationals may purchase apartments and other real estate in Bosnia and Herzegovina, subject to certain legal requirements.

In the Federation of Bosnia and Herzegovina, foreign individuals and legal entities may acquire ownership of real estate subject to reciprocity. In general, this means that citizens of Bosnia and Herzegovina should have corresponding property rights in the foreign buyer's country. The law presumes that reciprocity exists unless otherwise determined.

What should be checked before buying?

Before signing a purchase agreement, it is advisable to verify:

  • whether reciprocity requirements are met

  • ownership and existing encumbrances

  • Land Registry records

  • the terms of the purchase agreement

  • applicable taxes and other obligations

After the transaction, the buyer should complete the registration of ownership in the competent Land Registry.

It is also important to note that purchasing property does not automatically grant a foreign national the right to reside in Bosnia and Herzegovina. However, real estate ownership may, together with other statutory requirements, serve as a basis for temporary residence.
